Event Terms and Conditions
These Terms & Conditions apply to the Live Like Her Challenge, including the Brisbane and Gold Coast events (“Event”).
The Event is organised by Mangrove Housing Limited (“Organiser”).
By registering for or attending the Event, you agree to these Terms & Conditions.
1. Acceptance of Terms
By completing your registration, you confirm that:
• You have read and understood these Terms & Conditions.
• You agree to be legally bound by them.
• If registering a minor, you have authority to accept these Terms on their behalf.
If you do not agree, you must not participate.
2. Nature of the Event
The Event is a symbolic overnight fundraising experience designed to raise awareness and funds for older women experiencing homelessness.
Participants acknowledge that:
• The Event involves sleeping in their own vehicle.
• The Event is conducted in an outdoor or semi outdoor car park environment.
• Weather conditions may vary.
• Sleeping arrangements are basic and symbolic only.
Participation may involve discomfort.
3. Eligibility and Conduct
The Organiser reserves the right to determine eligibility for participation and may refuse, cancel or revoke participation at its discretion.
Participants must:
• Comply with all venue rules and conditions.
• Follow the reasonable directions of the Organiser, its authorised representatives, venue management and security personnel.
• Conduct themselves respectfully and lawfully at all times.
The Organiser may remove any participant whose behaviour is unsafe, unlawful, disruptive or inconsistent with the values of the Event.
4. Supervision of Minors
Participants under 18 years of age must be accompanied and supervised at all times by a responsible parent or legal guardian.
The Organiser does not provide childcare or supervision services.
Parents and guardians accept full responsibility for the safety, supervision and conduct of minors attending the Event.
5. Health and Assumption of Risk
Participation in the Event is voluntary and undertaken at your own risk. By participating, you acknowledge and accept that:
• The Event involves inherent risks, including risks associated with sleeping in a vehicle, outdoor conditions, large public gatherings and travel to and from the Event.
• You are medically and physically fit to participate.
• You assume all risks of injury, illness, loss or damage that may occur in connection with the Event.
Nothing in these Terms excludes rights under the Australian Consumer Law that cannot lawfully be excluded.
6. Release and Indemnity
To the fullest extent permitted by law, you:
• Release and discharge the Organiser, its directors, officers, employees, volunteers, contractors, sponsors and venue partners from any claim, liability, loss or damage arising from your participation in the Event.
• Indemnify and hold harmless the Organiser and the persons listed above from any claim, liability or expense arising from your participation, your breach of these Terms, or your negligent or unlawful conduct.
This clause survives the Event.
7. Personal Property
You are responsible for all property you bring to the Event, including your vehicle.
The Organiser accepts no responsibility for loss, theft or damage to personal property. Participants must not cause damage to venue or Event property.
8. Photography, Filming and Media
There may be significant media interest in the Event.
By registering for and attending the Event, you consent to:
• Being photographed, filmed or recorded.
• The use of your name, image, likeness and voice for promotional, fundraising, marketing and media purposes, including on social media and in sponsor materials, without compensation. If registering a minor, you provide consent on their behalf.
If you do not wish to be included in media coverage, you must notify the Organiser in writing prior to the Event and identify yourself upon arrival.
9. Fundraising Conduct Participants agree:
• Not to represent that their actions are on behalf of the Organiser beyond participation in the Event.
• To conduct all fundraising lawfully and ethically.
• Not to make misleading or deceptive statements about the Event or the Organiser.
The Organiser reserves the right to remove fundraising pages or participation if conduct is inappropriate or inconsistent with the values of the Event.
10. Animals
Animals are not permitted at the Event, except for certified assistance animals.
11. Event Changes and Cancellation
The Organiser reserves the right to modify, postpone or cancel the Event due to weather, safety concerns, venue requirements, emergency services direction or circumstances beyond its reasonable control.
To the extent permitted by law, the Organiser is not liable for any loss arising from such changes.
12. Medical Treatment
Participants consent to receiving first aid or emergency medical treatment if required during the Event and authorise the Organiser to contact emergency services where necessary.
13. Privacy
Personal information collected in connection with the Event will be used for Event administration and related communications and handled in accordance with applicable Australian privacy laws.
14. Governing Law
These Terms & Conditions are governed by the laws of Queensland, Australia. Any disputes are subject to the jurisdiction of Queensland courts.
